The Law Society of Ireland recently undertook a large-scale review of the Land and Conveyancing procedures in relation to property. Since 1st January 2019 changes were introduced in an effort to minimise the number of pre-contract enquiries and issues which would arise before a property transaction proceeds to completion. There are both pros and cons with the new system. Whilst in theory, the transaction might proceed at greater pace, the Purchaser has to be aware in particular of the consequences of “gazumping” a scenario whereby a Purchaser loses his bargain to a later, higher bid. It remains to be seen whether the changes introduced will lead to a cleaner and more efficient system.
